Law and neurosciences
This paper discusses several issues on the effect cognitive neuroscience may have concerning the current theoretical and methodological edifice of jurisprudence. Localizing, using neuroimage techniques (that also study lesions), the brain correlates that have to do with moral judgments seems to be without doubt one of the big events in the history of normative social sciences. The best neuroscientific model of normative judgment available today establishes that law operators possess, within their neural evaluative-affective systems, the presence of requirements, obligations and strategies. These constitute a “should be” that internalize rational and emotional reasons, which are integrated in the practical, theoretical and normative levels active in every process of exercising law.
